Terms of service

This Terms of Service (hereinafter referred to as “these Terms”) sets forth the conditions for using the online shop (hereinafter referred to as “the Service”) provided on this website by YUJINIA (operated by Yujin Corporation) (hereinafter referred to as “the Company”). Registered users (hereinafter referred to as “Users”) agree to use the Service in accordance with these Terms.

Article 1 (Application)
These Terms apply to all relationships related to the use of the Service between the User and the Company.
In addition to these Terms, the Company may establish rules and various provisions regarding the use of the Service (hereinafter referred to as “Individual Provisions”). Regardless of their names, these Individual Provisions constitute part of these Terms.
If the provisions of these Terms conflict with the Individual Provisions, the provisions of the Individual Provisions shall prevail unless otherwise specified therein.

Article 2 (User Registration)
To use the Service, the applicant for registration must agree to these Terms and apply for registration in the manner prescribed by the Company. Registration is deemed complete when the Company notifies the applicant of approval.
The Company may refuse registration if it determines that the applicant falls under any of the following, and has no obligation to disclose the reason:
Submitting false information during the registration process
Having violated these Terms in the past
Any other case in which the Company deems the registration inappropriate

Article 3 (Management of User ID and Password)
Users shall manage their User ID and password under their own responsibility.
Users may not transfer, lend, or share their User ID or password with any third party. If a login is performed with a User ID and password combination that matches registered information, the Company will regard it as the User’s own use.
The Company shall not be liable for any damages incurred due to the User ID or password being used by a third party, except in cases of intentional misconduct or gross negligence by the Company.

Article 4 (Sales Contract)
A sales contract is established when a User applies to purchase a product through the Service and the Company sends a notification accepting the application. Ownership of the product transfers to the User when the Company hands it over to the delivery carrier.
The Company may cancel the sales contract without prior notice if the User falls under any of the following:
Violation of these Terms
Failure of delivery due to unknown address or prolonged absence
Loss of trust between the Company and the User
Details regarding payment methods, shipping methods, cancellation of purchase applications, returns, etc. shall be determined separately by the Company.

Article 5 (Intellectual Property Rights)
Copyrights and other intellectual property rights related to product photos and other content (hereinafter “Content”) provided through the Service belong to the Company or the rightful owners. Users may not copy, reproduce, modify, or otherwise use such Content without permission.

Article 6 (Prohibited Acts)
Users shall not engage in the following when using the Service:

Acts that violate laws or public order and morals
Acts related to criminal activity
Infringement of intellectual property rights such as copyrights or trademarks included in the Service
Destroying or interfering with the Company’s servers or networks
Commercial use of information obtained through the Service
Acts that may obstruct the operation of the Service
Unauthorized access or attempts thereof
Collecting or storing personal information of other users
Impersonating other users
Providing benefits to anti-social forces
Any other acts deemed inappropriate by the Company

Article 7 (Suspension of Service Provision)
The Company may suspend or interrupt the Service, in whole or in part, without prior notice if it determines any of the following apply:
Maintenance or updates of computer systems related to the Service
Difficulty in providing the Service due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
Accidental failure of computers or communication lines
Any other situation where the Company deems it difficult to provide the Service
The Company shall not be liable for any damages incurred by Users or third parties resulting from such suspension or interruption.

Article 8 (Usage Restrictions and Deregistration)
The Company may restrict the User’s use of the Service or delete their registration without notice if the User falls under any of the following:
Violation of any provisions of these Terms
False information found in registration details
Credit card reported for payment becoming unavailable
Failure to fulfill payment obligations
No response to communications from the Company for a certain period
No use of the Service for a long period
Any case in which the Company deems the User inappropriate for the Service
The Company shall not be liable for any damages incurred by actions taken under this Article.

Article 9 (Disclaimer)
The Company does not guarantee that the Service is free of factual or legal defects (including safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security issues, errors, bugs, rights infringement, etc.).
The Company shall not be liable for any damages arising from the User’s use of the Service. However, if the contract between the Company and the User (including these Terms) falls under a consumer contract under consumer protection laws, this disclaimer does not apply. Even in this case, the Company shall not be liable for damages arising from special circumstances (including foreseeable damages).
The Company shall not be involved or responsible for transactions, communication, or disputes between Users or between Users and third parties.

Article 10 (Changes to Service Content)
The Company may change or discontinue the Service without notice and shall not be liable for resulting damages.

Article 11 (Changes to Terms)
The Company may change these Terms at any time without notifying Users. Continued use of the Service after changes constitutes agreement to the revised Terms.

Article 12 (Personal Information Handling)
The Company shall properly handle personal information obtained through the Service in accordance with its Privacy Policy.

Article 13 (Notices and Communication)
Notices between the User and the Company shall be conducted in the manner defined by the Company. Unless otherwise notified, the Company will consider the currently registered contact information valid and deem notices delivered at the time they are sent.

Article 14 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer or assign their contractual position or rights and obligations under these Terms to any third party without prior written consent from the Company.

Article 15 (Governing Law and Jurisdiction)
The interpretation of these Terms shall be governed by Japanese law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
In the event of a dispute related to the Service, the court having jurisdiction over the Company’s principal office shall be the exclusive agreed court of jurisdiction.
